The EB-5 visa is not a temporary visa. This is an immigrant visa that will grant the primary individual their spouse or any child under the age of 21 lawful permanent residence in the United States. Permanent residence is defined as coming to the United States with the intention of remaining permanently in the United States, commonly referred to as a (Green Card). Congress created the EB-5 investor program in 1990 to stimulate the US economy through job creation and capital investment through foreign investors.
This visa is also referred to as an entrepreneurial visa, meaning that the primary party is investing a prescribed amount of money, currently ranging from $500,000 to $1,000,000 (As of March 2017).
Each investor must be investing in a project which is a bona fide endeavor along with creating 10 new jobs; available to United States citizens or permanent resident aliens of the United States.
Under certain circumstances there are designated areas within the United States that are classified as high unemployment areas, (targeted employment areas: TEA). In these “geographic areas” the minimum investment may be $500,000 but must still create 10 new jobs.
In other areas of the United States, that are not designated TEA, the minimum investment would be $1,000,000 and must still create 10 new jobs per investor.
The investments may be a direct investment, which consists of the investor directly investing in a project or business and individually creating the required job count. This method requires the investor to operate and manage and conduct the reporting requirements per federal regulations. Another option is for an investor to utilize a designated regional center, who accepts investors into an approved project and provides the reporting and managerial responsibilities on behalf of the investor. The investor would not be required to be involved in the daily operation, nor would the investor be required to live in the “geographic area” of the investment.
